What are Tax Reliefs?

Tax reliefs in Kenya are reductions applied to your calculated tax (PAYE) that lower the amount of income tax you actually pay. They are different from deductions, which reduce your taxable income. Reliefs are subtracted directly from the tax amount after it has been calculated using the tax bands.

Personal Relief

Every resident individual taxpayer in Kenya is entitled to personal relief:

  • Monthly Amount: KES 2,400
  • Annual Amount: KES 28,800
  • This relief is automatic and applies to all resident employees regardless of income level.
  • It is subtracted from the gross tax calculated using the PAYE bands.

Insurance Relief

If you pay premiums for a health insurance policy (for yourself, your spouse, or your children), you qualify for insurance relief:

  • Rate: 15% of the insurance premiums paid
  • Monthly Cap: KES 5,000
  • Annual Cap: KES 60,000
  • The insurance policy must be with an insurance company registered in Kenya.
  • Both employer-provided and personal insurance policies qualify.

Insurance Relief Example

If your monthly health insurance premium is KES 10,000:

  • Insurance Relief = 15% x KES 10,000 = KES 1,500
  • Since KES 1,500 is below the monthly cap of KES 5,000, you get the full KES 1,500 relief.

If your monthly premium is KES 50,000:

  • Insurance Relief = 15% x KES 50,000 = KES 7,500
  • Since KES 7,500 exceeds the monthly cap of KES 5,000, your relief is capped at KES 5,000.

Disability Relief

Persons with disability who hold a valid exemption certificate from KRA are entitled to additional tax relief:

  • Monthly Amount: KES 2,400 (in addition to personal relief)
  • Annual Amount: KES 28,800
  • The employee must have a valid disability exemption certificate issued by KRA.

How Reliefs Affect Your Pay

Here is how reliefs reduce your PAYE using a practical example for an employee with KES 50,000 gross salary and KES 8,000 monthly insurance premium:

  1. Calculate taxable income (after NSSF and Housing Levy deductions)
  2. Apply tax bands to get gross tax
  3. Subtract Personal Relief: KES 2,400
  4. Subtract Insurance Relief: 15% x KES 8,000 = KES 1,200
  5. Result is your net PAYE payable

These reliefs can make a meaningful difference in your take-home pay. SmartHR Kenya automatically applies all applicable reliefs when processing payroll, ensuring employees pay only the correct amount of tax.
